By acceptance or use of this ticket for admission to the Captains Ballpark, the ticket holder agrees to the following terms and conditions and all other terms and conditions, including a WAIVER AND RELEASE OF LIABILITY and an AGREEMENT TO ARBITRATE AND A CLASS ACTION WAIVER. In the event that a legal game is not played, this ticket can be exchanged, subject to availability, for a ticket of equal value for any 2020 regular season home game.
WARNING: PAY ATTENTION TO THE BALL GAME AND OTHER ACTIVITY AT ALL TIMES. The ticket holder assumes all risk of injury and damages related to, directly or indirectly, the game of baseball and all associated entertainment, concession, and all other non-baseball activities, whether or not sponsored or directed by the Club, in all area[s] of the ballpark, whether occurring prior to, during, or subsequent to the actual playing of the game, or during batting and fielding practice, or between innings and other pauses in the game, including (but not limited to) injury by thrown bats, fragments thereof, thrown or batted balls and damage to personal property in or adjacent to the ballpark by any means. The ticket holder further assumes all risk of injury, illness, and damages related to, either directly or indirectly, contact with or exposure to contagion, disease, epidemic, pandemic, food-borne illness, foreign matter, contaminants, virus, bacteria, or other illness at the Event. The ticket holder agrees that the Lake County Captains and its affiliates, sponsors the opposing baseball team, the City of Eastlake, the National Association, the Midwest League, the participating clubs and their owners, officers, employees, agents and players are not liable for personal injury (including death) or damage related to such causes.
NOTICE: This ticket is good only for the game indicated and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use this ticket for that game. This ticket may be exchanged at the box office up to 48 hours prior to the scheduled game time for any remaining regular season home game, subject to availability. The ticket holder is admitted to the ballpark as a licensee on condition and by use of this ticket agrees: the ticket holder will not transmit or aid in transmission of any description, account, picture or reproduction of the baseball game (including pre- and post-game activities) to which this ticket admits ticket holder. Breach of the foregoing will automatically terminate this license. Violation of any Local, State or Federal ordinance, and action deemed improper by the licensor, including, but not limited to, any action which results in ejection from any area controlled by licensor or arrest by the proper authority, regardless of a later determination of its validity, will automatically terminate this license. Furthermore, management of the Captains (“Management”) reserves the right to deny admission to or eject any person who Management, in its sole discretion, determines poses a risk to the health and safety of other attendees and/or whose conduct violates these terms or is otherwise disorderly (or complicit in such conduct), without refund. The ticket holder grants permission to the participating clubs and their agents to utilize ticket holder's image or likeness incidental to any live or recorded video display or other transmission or reproduction in whole or in part of the event to which this admits ticket holder. All pyrotechnic displays are subject to cancellation in the event of adverse weather/wind conditions and no part of the ticket purchase price will be refunded as a result of such cancellation.
PROMOTIONAL GIVEAWAY ITEMS: One promotional giveaway item PER PERSON, NOT PER TICKET, will be distributed during designated home dates.
RAIN CHECK: In the event a legal game is not played due to weather, an act of God or any other reason
(4 _½ _innings if the Captains are ahead; 5 full innings if the Captains are behind or tied), or if a scheduled pyrotechnic display is canceled due to adverse weather/wind conditions, your ticket stub will serve as a rain check to any future regular season remaining game during the current year, subject to availability. Rain checks are not subject to any refund and shall bear no cash value. If issued as a complimentary admission, this ticket shall bear no value and is neither refundable nor exchangeable.
NO CASH OR CHECK REFUNDS WILL BE ISSUED FOR RAIN CHECK TICKETS. NO OUTSIDE FOOD OR BEVERAGE IS PERMITTED IN THE CAPTAINS PARK.
