The holder ("Holder") of this ticket ("Ticket") agrees to the terms and conditions on Ticket, full terms and conditions available at www.PawSox.com, and the rules and policies of the Pawtucket Red Sox Baseball Club, LLC ("Club"), all of which remain subject to change in Club's sole discretion.
TICKET IS A REVOCABLE LICENSE AND DOES NOT CONFER ANY PROPERTY RIGHTS OR INTERESTES ON HOLDER. CLUB RESERVES THE RIGHT TO REVOKE THE LICENSE GRANTED BY TICKET AT ANY TIME AND FOR ANY REASON IN ITS SOLE DISCRETION.
Holder agrees that any failure to abide by Club policies provides an appropriate basis for Club's revocation of Ticket (and all season tickets, where applicable) without notice or refund. Club may refuse Holder admission to or eject Holder from McCoy Stadium without refund if Holder fails to comply with any applicable Club policies or directions of Club management. Disorderly or inappropriate behavior, vulgar or offensive language, conduct that is not conducive to a family friendly environment, or interference with the play of the game may result in ejection from McCoy Stadium without refund, arrest, forfeiture of ticket privileges, and other legal action.
HOLDER VOLUNTARILY ASSUMES ALL RISK AND DANGER OF PROPERTY LOSS AND PERSONAL INJURY INCIDENT TO THE GAME OF BASEBALL AND RELATED ACTIVITIES AT MCCOY STADIUM, INCLUDING SPECIFICALLY (BUT NOT EXCLUSIVELY) THOSE RELATING TO THE STRUCTURE AND CONDITIONS OF MCCOY STADIUM, PARKING AT MCCOY STADIUM, AND THE DANGER OF BEING INJURED BY THROWN OR FLYING OBJECTS INCLUDING BATS AND BALLS. TO THE EXTENT PERMITTED BY LAW, HOLDER IRREVOCABLY WAIVES ALL CLAIMS OF ANY NATURE AGAINST CLUB, MINOR LEAGUE BASEBALL, CITY OF PAWTUCKET, STATE OF RHODE ISLAND, AND EACH OF THEIR PARENT AND AFFILIATED ENTITIES, AND THEIR AGENTS, LICENSEES, VENDORS, EMPLOYEES, INDEPENDENT CONTRACTORS, AND REPRESENTATIVES (COLLECTIVELY, "RELEASED PARTIES"), AND RELEASES AND DISCHARGES THE RELEASED PARTIES FROM ALL CLAIMS, LIABILITY, COSTS, EXPENSES, DAMAGES, OR LOSSES (WHETHER DIRECT OR CONSEQUENTIAL AND WHETHER ARISING UNDER STATUTE, FROM NEGLIGENCE, PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHERWISE) ARISING FROM OR IN CONNECTION WITH THE GAME OR EVENT FOR WHICH THIS TICKET GRANTS ADMISSION ("EVENT"), MCCOY STADIUM, OR ANY SERVICE PROVIDED OR ANYTHING SOLD THERE NOTWITHSTANDING THAT IT MAY HAVE BEEN CAUSED BY THE NEGLIGENT ACT OR OMISSION ON THE PART OF SUCH RELEASED PARTY OR PARTIES.
Holder is subject to McCoy Stadium rules and regulations. No chairs, coolers, or carry-in food or beverages allowed. Prohibited items maybe confiscated. All patrons and their belongings are subject to search by Club security personnel prior to gaining entry to McCoy Stadium and, by tendering Ticket for entry into McCoy Stadium, Holder consents to such search. Failure to consent to such search will result in denial of entry into McCoy Stadium.
Ticket may not be used for advertising, promotion, or other trade or commercial purposes without express written consent of Club. Holder shall not transmit or aid in transmitting any description, account, picture, video, audio, reproduction, or other information concerning Event. Club shall have the unrestricted right and license to use Holder's likeness as included in any broadcast (live or recorded), telecast, or photograph taken in connection with Event. Holder grants permission to Club and its agents, affiliates, and licensees to utilize Holder's image or likeness incidental to any live or recorded video display or other transmission or reproduction, in whole or in part, of Event, for any purpose whatsoever including commercial purposes.
All sales are final. No exchange or refund for any lost or stolen tickets or for any counterfeit tickets purchased on the secondary market. CLUB'S EVENT SCHEDULE (WHICH INCLUDES BUT IS NOT LIMITED TO EVENT DATES, TIMES, AND OPPONENTS) IS SUBJECT TO CHANGE AT ANY TIME.
Holder's use of Ticket constitutes acceptance of the foregoing terms.
