For good and valuable consideration, receipt of which is hereby acknowledged, I hereby release, discharge, and hold harmless Indians, Inc., The City of Indianapolis, The Capital Improvement Board, and the White River State Park Commission and their respective subsidiaries, affiliates, directors, officers, employees and agents (collectively, the “Released Parties”) from and against any and all claims, causes of action, or demands relating to or arising out of my activities as an on-field participant, spectator, or attendee at Victory Field (collectively, the “Activities”), and further agree to defend, indemnify and hold harmless the Released Parties and their insurers from and against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and other legal fees) they may incur as a result of claims made against them arising out of my participation in any of the Activities or any breach of this General Release (including but not limited to breach of any representation or warranty contained herein.)

I expressly assume all risk of illness (including but not limited to illnesses caused by or related to COVID-19) and/or injury (including permanent disability and death) relating to or arising from my participation in any of the Activities, howsoever caused or arising and whether by negligence, any intentional act or omission, or otherwise (of the Released Parties or other individuals engaging in any of the Activities) and accept personal responsibility for any damages that might result from such illness (including but not limited to illnesses caused by or related to COVID-19), injury, permanent disability, or death, including but not limited to all medical expenses, disability, and loss of income.

I grant full permission to the Released Parties to record, reproduce, broadcast, transit, publish, sell, distribute, perform, use and re-use, and to license others to exhibit, record, reproduce, broadcast, transmit, publish, sell distribute, perform, use and re-use, for any purpose, in any manner or by any means, whether now known or hereafter developed, without further notification, authorization or compensation to me or anyone on my behalf, my name (or any nickname) and likeness, and any photographs, videotapes, motion pictures, recordings, or other record concerning my participation in any of the Activities, worldwide and in perpetuity, and I represent and warrant that no further permission is required for the Released Parties to exercise such rights as provided herein.

I have full authority to execute this General Release and do so with the full knowledge of the facts and circumstances surrounding my participation and/or performance.

I acknowledge that I have read and fully understand the foregoing.
