AGREEMENT & RELEASE FROM LIABILITY
I acknowledge that I am voluntarily participating in “Bark in the Park” (the “Activity”) at Sutter Health Park, where I will be permitted onto the field with my dog. I certify that my dog is licensed and is fully up to date with all vaccinations, including, but not limited to, Rabies, DHPP, and Bordetella. I agree to follow the instructions/directives of authorized River Cats personnel and to behave, and cause my dog to behave, in a respectful and appropriate manner during the Activity. I assume all risks of my participation in accordance with this Agreement and release.

I AGREE AND AM AWARE THAT THE ACTIVITY COULD POSSIBLY BE HAZARDOUS OR DANGEROUS (e.g., POTENTIAL INJURIES FROM RUNNING ON THE FIELD, TRIPPING, SLIPPING, BEING RUN INTO BY ANOTHER PARTICIPANT OR DOG, OR BEING BITTEN BY A DOG) OR CAUSE PROPERTY DAMAGE. I UNDERSTAND THAT IN ADDITION TO THE ABOVE-MENTIONED RISKS, THERE ARE UNPREDICTABLE DANGERS IN THE ACTIVITY. I AM VOLUNTARILY PARTICIPATING IN THIS ACTIVITY WITH KNOWLEDGE OF THE POSSIBLE DANGERS INVOLVED TO ME AND HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY TO ME AND RISKS OF PROPERTY DAMAGE, AND I AGREE TO ASSUME MY OWN MEDICAL EXPENSES OF EVERY KIND IN THE EVENT OF INJURY.

In consideration for my participation in the Activity, I agree to the following:
(i) I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make a claim against, sue, or attach the property of the Sacramento River Cats, or any of its partners, affiliates, representatives, employees, or contractors or any of the partners, members, representatives, employees, or contractors of any such affiliate (all of the foregoing hereinafter referred to as the “Other River Cats Parties”) for any injury or damage resulting from the negligence or other acts, howsoever caused, by the River Cats or any of the Other River Cats Parties as a result of my participation in the Activity.
(ii) I hereby release each of the River Cats and the Other River Cats Parties from all actions, claims, or demands that I, my assignees, heirs, distributees, guardians, and legal representatives now have or may hereafter have for injury or damage resulting from my participation in the Activity.
(iii) Additionally, I hereby agree that I will indemnify and hold harmless the River Cats or the Other River Cats Parties (collectively known as the “Licensor Indemnified Parties”) and their respective agents from, and, if requested, shall defend them, without cost to the Licensor Indemnified Parties, against any and all third-party claims (including reasonable attorneys’ fees), with respect to property damage or personal injury of every nature whatsoever and in any manner arising directly or indirectly out of my participation in the Activity and the acts of my dog or my breach of this Agreement.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE SACRAMENTO RIVER CATS (ON BEHALF OF BOTH THE RIVER CATS AND THE OTHER RIVER CATS PARTIES), AND SIGN IT ON MY OWN FREE WILL.
