FRISCO ROUGHRIDERS
TICKET TERMS AND CONDITIONS
By using this ticket (“Ticket”) for admission to Riders Field (the “Stadium”), Ticket holder, on his/her own behalf and on behalf of any accompanying minor(s) (collectively, the “Holder”) agrees to the following terms and conditions:
This Ticket grants Holder a non-transferable revocable license to: (a) attend the event on the date set forth on the Ticket (the “Event”); and (b) sit in the Section, Row and Seat identified on the Ticket, unless this Ticket is designated “General Admission.” Frisco RoughRiders LP (“RoughRiders”) reserves the right to revoke such license, in their sole discretion, at any time and for any reason, by tendering to Holder the purchase price of the ticket(s). This Ticket must not be resold or offered for resale in any manner not authorized by the RoughRiders, or at a price in violation of any Federal, State, or local law or regulation.
The license granted by this Ticket may also be terminated without refund of any portion of the purchase price if Holder violates these Terms and Conditions, appears to be or is intoxicated, engages in conduct deemed by the RoughRiders to be improper, disorderly or unbecoming or uses vulgar or abusive language. Holder is also subject to seat relocation. By tendering this ticket to enter the Stadium, Holder hereby consents to security screening, whether by walk-through metal detection, handheld metal detection, bag checks, or otherwise, and Holder hereby acknowledges and agrees that the RoughRiders/Baseball Entities (defined below) assume no liability to Holder’s person or property as a result of any such security screening and Holder waives any such related claims against the RoughRiders/Baseball Entities. This Ticket may not be used for advertising, promotion (including sweepstakes or contests) or other trade or commercial purposes without the express prior written consent of the RoughRiders.
Holder agrees that: (a) Holder shall not transmit or aid in transmitting any information about the Event to which the Ticket grants admission, including, but not limited to, any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data, or visual), in any media, of all or any part of the Event or related events, without the express written consent of RoughRiders; (b) RoughRiders are the exclusive owner of all copyrights and other proprietary rights in the game and game information; and (c) RoughRiders, the Texas League, the National Association of Professional Baseball Leagues (“MiLB”), Office of the Commissioner of Baseball (“MLB”), City of Frisco, other MiLB and Major League Baseball clubs, and each of their respective parents, subsidiaries and/or affiliated entities, which, now or in the future, controls, is controlled by, or is under common control with MiLB, MLB and/or RoughRiders, and each of the respective directors, officers, employees, agents, sponsors, partners, contractors, successors and assigns of the above entities (collectively, the “RoughRiders/Baseball Entities”) shall have the unrestricted right and license to use Holder’s name, image, and/or likeness taken at or around the Stadium as included in any broadcast, telecast, photograph, or in any other medium whether now known or hereafter devised.
WARNING: Please stay alert and be aware of your surroundings at all times. During any Minor League Baseball regular season game (“Game”), batted baseballs and bats and fragments thereof may be thrown or hit anywhere in the Stadium. If Holder is concerned about the seat location on the front of the Ticket, relocation may be requested. All relocations are subject to availability, may be in a different area in the Stadium and may require additional payment.
COVID-19 is an extremely contagious disease that can lead to severe illness and death. An inherent risk of exposure to COVID-19 exists in any public place including the Stadium regardless of precautions that may be taken. By holding this Ticket, you agree to assume all risks associated with COVID-19 and other infectious and/or communicable diseases, viruses, bacteria or illnesses, as well as agree to all other terms and rules set forth at www.ridersbaseball.com/ticketback. In connection with the Event, Holder agrees to follow all applicable federal, state, county, city and RoughRiders directives in connection with, and in order to reduce the risk or spread of disease or sickness.
WAIVER AND RELEASE OF LIABILITY: The Holder recognizes that attendance at the Event is voluntary and may result in personal injury or property damage. The Holder assumes all risk and danger incidental to the Event, including the sport of baseball and the danger of batted balls and bats and fragments thereof. Holder agrees that: (a) the RoughRiders/Baseball Entities; (b) the Ticket manufacturer, provider and/or agent; and (c) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, trustees, partners, members, directors, officers, owners, agents, representatives, servants and independent contractors of each of the foregoing entities (collectively, the “Released Parties”), shall not be responsible for any personal injury (including death), property damage, or other loss suffered in connection with the Event and/or the negligence of any of the Released Parties. Holder releases the Released Parties from any and all claims which Holder and/or any Minor have or may have for any other cause of action arising out of the Agreement, use of this Ticket, attendance at, observation of, and/or participation in the Event.
RAIN CHECK:
(a) Games: In the event a regulation game as defined by the Official Baseball Rules (i.e., four and one-half (4 1/2) innings if the home club is ahead or five (5) full innings if the visiting club is ahead or the Game is tied) is not played, the Ticket will constitute a rain check that can either be: (i) used for admission to the rescheduled Game, if any, subject to certain doubleheader and Premium Game limitations; or (ii) exchanged for a Ticket comparable in price and location to another, similar Game within 12 months of the originally scheduled Game, subject to availability.
(b) All Other Events: The Ticket will constitute a rain check that can be, within 12 months of the originally scheduled date of the Event: (i) used to attend a rescheduled performance of the same Event; or (ii) exchanged for a ticket comparable in price and location to another, similar Event.
ADDED VALUE INCLUDED (IF ANY) IS LISTED ON THE FRONT OF THIS TICKET, IS INCLUDED IN THE PRICE OF THIS TICKET, AND SHALL EXPIRE UPON CONCLUSION OF THE EVENT FOR WHICH THIS TICKET PROVIDES ADMITTANCE. ADDED VALUE CAN BE USED FOR PURCHASES OF FOOD, BEVERAGES, AND MERCHANDISE INSIDE THE BALLPARK. CERTAIN CONCESSION STANDS AND RETAIL STORES MAY CLOSE PRIOR TO THE END OF THE EVENT. PAID VALUE PORTION OF ADDED VALUE SHALL BE APPLIED TO PURCHASES BEFORE PROMOTIONAL VALUE.
ALL EVENT TIMES SUBJECT TO CHANGE. SAFEGUARD YOUR TICKETS. ROUGHRIDERS ARE NOT RESPONSIBLE FOR LOST, DESTROYED, COUNTERFEIT, OR STOLEN TICKETS.
NO SMOKING IN THE SEATING AREA. SMOKING PERMITTED IN DESIGNATED AREAS ONLY. NO CANS, GLASS BOTTLES, OR OUTSIDE ALCOHOLIC BEVERAGES PERMITTED IN THE STADIUM. TICKET PRIVILEGES DO NOT REPRESENT A PROPERTY RIGHT. THE OPPORTUNITY TO RENEW OR PURCHASE A TICKET IS A PRIVILEGE GRANTED BY THE ROUGHRIDERS AND MAY BE WITHDRAWN AT THE ROUGHRIDERS DISCRETION. THIS TICKET IS YOUR TICKET AND WILL ALLOW ENTRY TO STADIUM THE FIRST TIME IT IS SCANNED AND ALL OTHER TICKETS FOR THIS SEAT (WHETHER PAPER, DIGITAL, OR OTHERWISE) SHALL BECOME VOID. DUPLICATION MAY PREVENT YOUR ADMITTANCE TO THE EVENT. THE ROUGHRIDERS ARE NOT RESPONSIBLE FOR ANY INCONVENIENCE OR LOSS CAUSED BY DUPLICATION. IN THE EVENT DUPLICATE COPIES APPEAR, THE ROUGHRIDERS RESERVE THE RIGHT TO REFUSE ENTRY TO ALL TICKET HOLDERS.
BY ATTENDING THE EVENT, HOLDER AGREES THAT ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THIS LICENSE SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION. HOLDER SHALL NOT BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER INDIVIDUALS OR ENTITIES, OR ARBITRATE AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.
BY ATTENDING THE EVENT, HOLDER IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY AND AGREEMENT TO ARBITRATE TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. IN THE EVENT HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF ANY MINOR, HOLDER SHOULD NOT ENTER THE STADIUM OR IMMEDIATELY LEAVE WITH SUCH MINOR.
COVID-19 and Other Infectious and/or Communicable Diseases, Viruses, Bacteria or Illnesses
This section is an acknowledgement and express assumption of risk and release of liability in any way related to or arising from being exposed to or contracting COVID-19 (as defined by the World Health Organization) and any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof (collectively, “Communicable Disease”) in and around any part of the Stadium or surrounding grounds or parking areas, to which the ticket provides access. By holding this ticket, you are acknowledging and confirming on your behalf, and on behalf of any individual who uses this ticket (including any minor children), both now and in the future, that you understand and expressly assume the risk that you may be exposed to COVID-19 or other Communicable Disease. You expressly understand that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. You further acknowledge and understand that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that you will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in your decision to use the ticket that cannot be eliminated. You further acknowledge and understand that, if infected with COVID-19 or other Communicable Disease, you may infect others you subsequently come in contact with, even if you are not experiencing or displaying any symptoms of illness, and that the risk of spreading COVID-19 or other Communicable Disease to others remains at all times. Accordingly, you further agree that you will not utilize this ticket, or knowingly allow another person to utilize the ticket, if within fourteen (14) days preceding the ticketed event, you or the individual using the ticket has:
a) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR
b) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR
c) traveled to a country that is subject to a U.S. State Department Level 4 “Do Not Travel” health advisory or a CDC Level 3 Travel Health Notice (each, a “Prohibited Country”); OR
d) been in direct contact with or the immediate vicinity of (collectively, the “Encounter”) any person who is either confirmed or suspected of being infected with COVID-19 or other Communicable Disease or who has travelled to a Prohibited Country within the fourteen (14) days preceding the Encounter.
You agree that this section is intended to be a binding and full waiver of claims and release of liability with respect to any controversy, claim or dispute that may arise out of or during use of this ticket that is related to exposure to or the contraction of COVID-19 or other Communicable Disease.
SPECIFICALLY, YOU AGREE THAT YOU, ON BEHALF OF YOURSELF AND YOUR PERSONAL REPRESENTATIVES, HEIRS, SPOUSE, GUARDIANS, EXECUTORS, ADMINISTRATORS, SUCCESSORS, ASSIGNS AND NEXT OF KIN HEREBY WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS AND AGREE NOT TO SUE THE ROUGHRIDERS AND THE ADDITIONAL RELEASED PARTIES NOTED BELOW WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY (INCLUDING, WITHOUT LIMITATION, FOR PERSONAL INJURIES OR WRONGFUL DEATH) THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE FOLLOWING YOUR USE OF THE TICKET, OR DURING YOUR PARTICIPATION IN ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE CLUB OR OTHER RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING ANY VENUE DURING ANY COMMUNICABLE DISEASE EPIDEMIC OR PANDEMIC, INCLUDING THE COVID-19 PANDEMIC. YOU FURTHER AGREE THAT THE FOREGOING RELEASE OF LIABILITY AND COVENANT NOT TO SUE EXTENDS TO AND ENCOMPASSES ANY AND ALL CLAIMS, LIABILITIES OR DEMANDS THAT RELATE IN ANY WAY TO EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE, BY ANY OTHER INDIVIDUAL, INCLUDING BUT NOT LIMITED TO MINOR CHILDREN AND/OR FAMILY MEMBERS, AS A RESULT OF USING TICKETS AND/OR AS A RESULT OF THEM BEING EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY YOU. TO THE EXTENT PERMITTED BY LAW, YOU FURTHER AGREE THAT IT IS YOUR INTENTION THAT THE FOREGOING RELEASE OF LIABILITY AND COVENANT NOT TO SUE IS BEING ENTERED BY YOU ON YOUR OWN BEHALF, AS SET FORTH ABOVE, AND ALSO ON BEHALF OF ANY OTHER INDIVIDUAL WHO USES A TICKET. The “Released Parties” shall include (a) the Office of the Commissioner of Baseball and its related entities (“MLB”), Major League Baseball Properties, Inc. (“MLBPI”) and its related entities, MLB Advanced Media, L.P. (“MLBAM”) and its related entities, each of the Major League Baseball Clubs, the Texas League, the National Association of Professional Baseball Leagues (“MILB”) and every director, officer, owner, stockholder, trustee, partner, employee, agent, independent contractor and consultant of MLB, MLBPI, MLBAM, MILB and the respective related entities and members of each of the foregoing (the “Baseball Parties”); (b) the owners and operators of the venues in which the 2021 season will be played (the “Venues”), and event sponsors, contractors, vendors, operators, agencies and advertisers of the Baseball Parties and Venues; (c) licensees, and retail, concession, broadcast and media partners of the Baseball Parties; (d) press and other media; (e) vendors that may provide testing or medical services; (f) entities and individuals providing accommodation and transportation to or from the Venues; (g) other entities and individuals who enter the Venues; and (h) the respective parent, subsidiary, affiliated and related companies and officers, directors, employees, agents, licensees, contractors, sub-contractors, insurers, representatives, successors, assigns of each of the foregoing entities and persons; and (i) the City of Frisco and its respective officials, members, officers, directors, employees, agents and servants.
This acknowledgement and express assumption of risk, waiver of claims, and release of liability is intended to be as broad and inclusive as is permitted by law. If any part of this provision is held to be invalid or legally unenforceable for any reason, the remainder of this provision shall not be affected thereby and shall remain valid and fully enforceable.
In order to protect the health and safety of the holder of the ticket and all others, the ticket holder must comply with all RoughRiders and Stadium policies, all policies of the Centers for Disease Control and Prevention, and all laws and policies of all applicable federal, state and city authorities, in each case respecting COVID-19 and other Communicable Disease. RoughRiders and its designees have the right to deny admission to or eject any person who RoughRiders or such designees determines, in its sole discretion, poses a risk to the health or safety of others and/or whose conduct violates these terms.
Ticket holder consents to health screenings and other precautions related to COVID-19 and other Communicable Disease that may be required as a condition for use of this ticket, including all precautions required by the league and RoughRiders while at the Stadium or surrounding grounds or parking areas, such as, but not limited to, distancing requirements and the wearing of masks in designated areas.
The RoughRiders/Baseball Entities reserve the right to amend or supplement these Terms and Conditions and/or Stadium policies. Information about, and/or revisions or amendments to these Terms and Conditions and/or Stadium policies may be posted on www.milb.com**/frisco** (“Website”) from time to time. It is the responsibility of the Holder to read and comply with all information. The RoughRiders/Baseball Entities are not responsible for problems, losses or inconveniences experienced because Holder did not read information regarding these Terms and Conditions and/or Stadium policies.
